1. The instant lawsuit was concluded on July 15, 2016 as the withdrawal of the lawsuit.

2. The costs of lawsuit shall be the costs of lawsuit after the lawsuit is completed.

The Plaintiff was notified of the legitimate date for pleading, but failed to appear on the second date for pleading opened on March 8, 2016, and on the fourth date for pleading opened on June 14, 2016, and on the fourth date for pleading opened on June 14, 2016; the Defendant or the Defendant’s attorney was present on each of the above dates for pleading but failed to state his/her opinion; and the Plaintiff submitted an application for the designation of the date on July 27, 2016 after one month from the date for pleading.

According to the above facts, the plaintiff and the defendant were absent on two occasions even after being notified of legitimate date, and did not file an application for designating the date within one month thereafter, so the lawsuit in this case was terminated as of July 15, 2016 pursuant to Article 268(2) of the Civil Procedure Act.

Since the plaintiff's litigation relationship is unclear, such as submitting an application for designation, etc., a declaration of termination of litigation shall be made in order to clarify that the lawsuit in this case is terminated.
