A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On September 26, 2018, at around 11:56, the Defendant: (a) creshed the victim C in Pyeongtaek-si B into other water surface and intruded into the cresh in other water surface; (b) 30 km of the market price, which is the victim’s possession located in the open surface, and loaded about 30 km of the scrap metal in the open surface, into the luxus, and stolen it into the Defendant’s D cargo vehicle operated by the Defendant.

2. On September 27, 2018, from around 23:06 to September 00:15, 2018, the Defendant: (a) went into the above water surface in the same manner as described in paragraph (1) and intruded into the above water surface; and (b) placed approximately 100 km in the market price, which is the victim C owned by the victim at the open site, carried about about 10 km in the relevant cargo unit.

3. Larceny;

A. At around 03:00 on December 13, 2018, the Defendant stolen construction materials, such as steel bars worth KRW 200,000, at the construction site located in Ansan-si, and the victim F, who was located therein, from the foregoing cargo vehicle.

B. On December 13, 2018, from around 03:40 to 05:00, the Defendant: (a) stolen construction materials, such as steel plates, etc., at the victim I, which were located in the open-site G; and (b) at the victim I, who was located in the open-site, from around 03:40 to around 05:00; and (c) stolen the construction materials, such as steel plates, at the market

C. On January 24, 2019, at the construction site located in Pyeongtaek-siJ around 02:21, the Defendant: (a) stolen three tons of steel bars equivalent to KRW 2,00,000, the market price of the victim K owned by the Defendant; (b) loaded them into the said cargo.

4. On September 26, 2018, the Defendant violated the Road Traffic Act (unlicensed driving) without obtaining a driver’s license, driving of a D freight vehicle at approximately 15 km section from Ansan apartment to Pyeongtaek-si, and driving the said vehicle over a total of 31 times from that time to February 27, 2019, as shown in the list of crimes in the attached Table.
