A defendant shall be punished by imprisonment for four months.
However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. A thief, around 10:00 on April 14, 2020, the Defendant stolen a 3.4 million won in cash, which is the victim’s possession, and two copies and seals of the post office bankbooks, from the victim C, located in front of the entrance, at the house of the victim C located in Seojin-jin-gu Seoul Special Metropolitan City on April 14, 202.
2. Forgery of private documents and the display of private documents;
A. At around 11:41 on April 14, 2020, the Defendant: (a) prepared a letter of request for deposit in the name of the former post office located in 99, Seogcheon-gu, Seogcheon-gu, Seogcheon-gu, Seogcheon-ro, and prepared a letter of request for deposit under C, stating “D”, “15000” in the Account Number column; (b) “C” in the Account Number column; (c) “C” in the Account Number column; and (d) affixed C’s seal on the Account Name column; and (d) presented as if he/she knew of the fact that he/she completed the written request for deposit to employees under the name of the said post office as above, as a document duly formed.
B. On April 14, 2020, the Defendant entered “D”, “1000,” “14 April 14, 200,” and “C” in the column for the date of preparation in the account number column in the above-mentioned method at the above-mentioned main post office around 11:53, the Defendant prepared one copy of the deposit application form in the name of “C” and presented as if the said written request form was a document duly formed.
C. At around 12:41 on April 14, 2020, the Defendant stated in the account number column “D”, “5000” in the face value column, “C” in the account number column, and “C” in the name of the subscriber, and written a written application for deposit in the name of “C” with the seal affixed by the Defendant to the name of the above post office, which may be known to the employees under the name of the above post office.
