피고인은 2019. 1.경부터 2019. 11. 18.경까지 사이에 서울 도봉구 B에 있는 자신의 집에서, 컴퓨터를 이용하여 불상의 여성들의 나체 또는 성관계 사진과 유명 여성 연예인들의 얼굴을 합성한 음란물 사진 수백 장을 제작한 후 이를 판매할 목적으로 C 사이트 접속한 다음 피고인이 개설한 블로그 ‘D’ (E)에 ‘대량 판매!! 총 3081장, 폴더 198개 크기만 무려 1.22GB!!! 154,050원어치를 13만원에 판매하겠습니다!! 모든 결제는 선불입니다.(문상, 계좌이체 가능 단, 문상은 최대 4만원까지만 결제가능)’라는 등 광고 글을 게시하고, 2019. 11. 18.경 위와 같은 광고 글을 보고 연락한 제주지방경찰청 소속 경찰관으로부터 대가 명목으로 피고인 명의 F은행 계좌로 10,000원을 송금받고 위와 같이 제작한 합성 음란물 사진 파일 200개가 압축파일 형태로 저장된 ‘G’ 파일을 이메일로 전송해주어 판매한 것을 비롯하여 2019. 2. 12.경부터 2019. 11. 18.경까지 별지 범죄일람표 기재와 같이 총 67회에 걸쳐 유명 연예인의 얼굴을 합성한 합성 음란물 사진 파일을 판매하였다.
