Reasons
Punishment of the crime
[Criminal Power] On January 17, 2019, the Defendant was sentenced to a suspended sentence of two years on July 12, 2019 by imprisonment with prison labor for a violation of the Act on the Control of Narcotics, Etc. at the Seoul Western District Court on January 17, 201, and the said judgment became final and conclusive.
【Criminal Facts】
The defendant is not a person handling narcotics.
1. Violation of the Narcotics Control Act;
A. around September 2018, the Defendant purchased a philophone by using approximately KRW 500,000 to D in front of the Yeonsu-gu Incheon Association C, Yeonsu-gu, Incheon, and by using approximately 1.5 grams of psychotropic drugs that are contained in a single-use injection device from D (i.e., a single-use philophone; hereinafter referred to as “philophone”).
B. On June 23, 2019, from around 23:00 to 24:00 of the same day, the Defendant received opphones from “F” located in Yeonsu-gu Incheon Metropolitan City E to G free of charge 0.2g of opphones by giving and receiving opphones.
C. At around 19:00 on July 10, 2019, the Defendant administered phiphones by inserting approximately 0.07gopon in a single-use injection machine in the Yeonsu-gu Incheon Metropolitan City E, and dilutioning it with a living water, and in the way of injection into the right arms.
At around 20:00 on August 13, 2019, the Defendant injected 0.08goponon in a one-time injection machine, dilution with raw water, and injection into the right arms, in a way of injecting 0.08gopon.
E. On August 28, 2019, at around 23:00, the Defendant administered phiphones by inserting approximately 0.08ghopon in a single-use clopon in the bedroom of “F” located in Yeonsu-gu Incheon Metropolitan City E, and inserting it into the right arms after dilutioning it with bio-compopons.
F. At around 22:00 on September 1, 2019, the Defendant: (a) injected 0.07goponon in a one-time clocket in Yeonsu-gu Incheon Metropolitan City E; and (b) injected the copon into the right arms following the dilution of bio-phones.
G. On September 2, 2019, the Defendant is located in the “F” bedroom located in Yeonsu-gu Incheon Metropolitan City E from September 11, 2019.
