피고인은 2014. 3. 20. 00:58경 부천시 원미구 B건물 나동 502호 피고인의 집 출입문에서 ‘아버지가 엄마하고 저를 때린다’라는 피고인의 딸 C의 신고를 받고 출동한 부천원미경찰서 D지구대 소속 순경 E이 피고인의 집으로 들어가려고 하자 위 E에게 ‘씨발! 니들이 뭔데 남의 집에 들어오려고 하느냐. 좆같은 놈들아! 여기 우리집이야! 무단침입 하지마’라고 욕설과 고함을 지르며 주먹을 쥔 채 팔을 사방으로 휘두르고 손으로 E의 팔과 가슴을 여러 차례 밀치며 발로 E의 발을 걷어차는 등 폭행하였다.
