A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On September 27, 2019, at around 08:00, the Defendant was placed in custody and operated the said car in front of the restaurant operated by the victim C (W, 58 years of age) in the Siljin-si, and the previous victim, who was the Defendant and the deceased, was found to be the victim, and did not come to the Defendant, but did not look at the victim, and did not talk with the victim, and went to the Defendant’s Dmea car.

Although the Defendant received a demand from the victim over several occasions, the Defendant stated that “I will not leave, I will not die.” to the victim, and that the Defendant driving the said vehicle in an amount of about 5 km up to F in Jin-si, thereby preventing the victim from getting out of the said vehicle for about 10 minutes.

Accordingly, the defendant detained the victim.

2. 특수협박 피고인은 2019. 9. 27. 08:10경 위 F에서, 위 피해자를 태운 채 피고인의 위 승용차를 주차한 후, 위 피해자로부터 “왜 그러느냐, 나도 힘들다, 오빠는 내 생각도 안하고 멋대로 하냐.”고 항의를 받자 화가 나 위 승용차 내에 보관하고 있던 위험한 물건인 라이터 오일 1통을 꺼내 승용차 바닥과 피해자의 상의에 뿌리는 시늉을 하고 위험한 물건인 라이터1개를 들어 피해자에게 보여주며 “불을 붙이겠다, 죽여버리겠다.”고 말하며 마치 불을 붙일 듯이 행동하여 겁을 주었다.

Accordingly, the defendant carried dangerous objects and threatened the victim.

3. In the above F at the time and time set forth in the above paragraph 2 above, the injured Defendant: (a) intending to take the victim’s body back by getting the victim from the damaged passenger car to the victim’s hand; (b) intending to take the victim’s head knife by hand; (c) intending to take the victim’s body back to the victim’s right shoulder by drinking the body knife; and (d) tightly, the victim’s body knife to the victim’s body by hand.
