Defendant
A is a person who manufactures and sells bags with a forged well-known trademark attached (hereinafter referred to as "representative") and the defendant C and the defendant B are those who manufacture and deliver each "representative or manager" book.
1. Defendant A and Defendant C conspired to commit the crime of conspiracy with Defendant A and Defendant C: (a) leased and provide the production of the original body, metal decorations, labels, etc. necessary for the production of a bank; and (b) requested the manufacture of a bank by a manager or a manager; and (c) Defendant C conspired to manufacture a bank by a manager or a manager, who is requested by Defendant A, or a manager, who is requested by Defendant C.
피고인들은 공모하여 2012. 4. 20.경부터 2012. 10. 19.까지 서울 강서구 E 지하 1층에 있는 ‘짝퉁’가방 제조공장에서, 상표권자 ‘샤넬’의 등록상표인 ‘CHANEL'(상표등록번호 제071324호)과 동일한 모양의 위조 상표가 부착된 가방 1,000점(정품추정시가 합계 5,000,000,000원 상당)을 제조하여 성명불상의 ’짝퉁‘상품 도매업자에게 1점당 60,000원 내지 70,000원 상당에 판매하였고, 2012. 10. 19.경 피고인 A이 ’짝퉁‘상품 보관 및 운반 차량으로 이용하는 F 카니발 승용차에 위 상표가 부착된 가방 20점(정품추정시가 합계 100,000,000원 상당)을, 위 제조공장에 위 상표가 부착된 가방 27점(정품추정시가 합계 135,000,000원 상당)을 판매할 목적으로 소지, 보관함으로써 위 상표권자의 상표권을 침해하였다.
