Defendant

A Imprisonment with prison labor of one year and six months, and Defendant B shall be punished by imprisonment with prison labor of one year.

However, as to Defendant B, this shall not apply.

Punishment of the crime

No one shall use a trademark identical with or similar to the registered trademark of another person for goods identical with or similar to the designated goods without legitimate authority.

Defendant

A, from February 2006, manufactured bags, etc. in China and sold them in Korea, in collusion with B around December 2012, decided to bring in semi-finished goods, such as wallets and bags, on which a forged trademark is attached, into Korea and manufacture them as finished goods.

On January 7, 2013, at a factory located underground in Yeongdeungpo-gu Seoul Metropolitan Government, the defendant A imported semi-finished goods with a forged trademark in China and carried them into Korea, and brought the above semi-finished goods to B, and ordered the manufacturing of finished goods. The defendant B manufactured and sold finished goods such as manufacturing and selling finished goods, such as receiving processing costs equivalent to 2,000 won per unit of the goods, attaching a spab in the original half-finished goods with F who is a woman living together, attaching a spab in the original half-finished goods, making a spabling with the Defendant F.

피고인들은 이와 같이 2013. 1. 7.경 상표권자 루이비통 말레띠에사가 국내 특허청에 등록한 상표(등록번호 : 제109060호)의 위조 상표가 부착된 지갑을 제조한 것을 비롯하여 그 무렵부터 2014. 1. 17.경까지 별지 범죄일람표 1 기재와 같이 위조 상표가 부착된 지갑, 가방 등 총 26,913점(정품 추정시가 : 23,776,470,000원 상당)을 제조하고, 계속하여 2014. 1. 21.경 서울 영등포구 E에 있는 공장에 상표권자 샤넬이 국내 특허청에 등록한 CHANEL 상표(등록번호 : 제249259호)의 위조 상표가 부착된 지갑의 금속장식 330점 등 별지 범죄일람표 2 기재와 같이 반제품 총 16,291점 상당을 위조 상품을 제조할 목적으로 보관하였다.
