(2019 Highest 102) around June 7, 2018, the Defendant: (a) while working for daily work at the D Logistics Center located in Gyeonggi-si, Gyeonggi-si; (b) obtained a certificate of access; (c) knew that the key of the object box kept in the Pyeongtaek-si, does not lock; or (d) made it easy for the Defendant to unsatisfy by using the said certificate of access to the said Logistics Center; (d) stolen the cash containing the right to the said Logistics Center; or (e) stolen the cash via the mobile phone small payment.

1. 야간건조물침입절도 피고인은 2018. 8. 22. 19:00~22:00경 사이에, 소지하고 있는 출입증을 사용하여 D물류센터 팀장 E이 관리하는 위 물류센터 안으로 들어간 후, 피해자 F가 2층 휴게실에 놓아둔 가방 안에 들어있는 현금 5,000원을 피해자 몰래 가져간 것을 비롯하여, 그때부터 2018. 10. 14.경까지 별지 범죄일람표(1) 기재와 같이 총 6회에 걸쳐 현금 합계 40,000원, 휴대전화 2개, 에어팟 1개, 가방 1개 등의 금품을 몰래 가져갔다.

On September 3, 2018, at the above logistics center around 19:02, the Defendant entering the building: (a) came back to the D Logistics Center managed by the victim E seven times in total, as shown in the attached list of crimes (2) from around October 9, 2018, after recognizing the access certificate possessed for the purpose of larceny or computer-use fraud; and (b) entering into the 1st entrance.

Accordingly, the defendant invadeds on the building managed by the victim.

3. Between October 6, 2018 and around 09:00 to 13:30 on October 6, 2018, the Defendant: (a) opened a locking device using a sadver and opened a cellular phone, one transportation card to bring the victim out; and (b) from that time, the Defendant came to bring about 3F-218 things used by the victim G in the three-story resting room of the said logistics center.
