A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is not a person handling narcotics.

1. Around October 2013, the Defendant: (a) was parked near the Defendant’s residence in Pyeongtaek-si B; (b) made marijuana tobacco in a passenger car using the Defendant’s XGGG franchises as a newspaper site; (c) made marijuana tobacco in a passenger car; and (d) smoked by a horse.

2. On March 23, 2014, around 23:00, the Defendant: (a) parked in the collection distance of Asan Mando-Eup located in Pyeongtaek-si; (b) made marijuana tobacco through newspapers with approximately 0.5gg of 0.5g of mariju in a car; and (c) smoked by a horse with a smoker.

3. On December 21, 2014, the Defendant: (a) around 21:00, at the back of the Defendant’s residence as indicated in paragraph (1), made marijuana tobacco using the hemp seed coats as a newspaper with approximately 0.25g of its seed coats; and (b) smoked in a rash.

4. On February 3, 2015, at around 17:30, the Defendant possessed approximately 0.37g of hemp seeds for the purpose of smoking in the Defendant’s residence indicated in paragraph (1).

1. The crimes related to narcotics, etc. with reasons for sentencing in the proviso of Article 67 of the Act on the Control of Narcotics, etc. shall not be limited to the elimination of the body and mind of an individual, and shall harm the national health or otherwise be different.
