A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
. The Defendant, “2019 Highly 3182,” who had reported the marriage on January 29, 1980, was divorced on May 9, 1996.
Even after divorce, the Defendant was frequently traveling from B's house due to the problem of raising children, and was issued with a certificate of the personal seal impression, and used B's proxy form to forge B's name and borrow money as a guarantor.
1. On February 8, 2019, the Defendant committed the crime: (a) around February 8, 2019, the C community self-governing center located in Ulsan-gu C with the intent to exercise the certificate; (b) on the proxy form for issuance of the certificate of personal seal impression, the Defendant, without authority, forged a letter of proxy for issuance of B certificate of personal seal impression, a private document stating that “B”, “D” in the resident registration number column, and address column, “B” in the letter of proxy for issuance of the certificate of personal seal impression attached to B’s seal impression affixed by the Defendant on his/her own seal affixed by the Defendant on his/her name; and (c) exercised the forged letter of proxy as if it was a document duly formed with the employee of the resident self-governing center under his/her name, who is aware of the forgery.
2. On February 26, 2019, the Defendant committed the crime at a law firm Gnotarial office on the 2nd floor in Ulsan-gu, Ulsan-gu around February 26, 2019, the Defendant, without authority, forged a letter of proxy in the name of B, a private document signed by the Defendant with the seal affixed by the Defendant on the letter of delegation, with the purpose of exercising the authority, to use it, as “B”, “B” in gold-gu, Seoul-do, U.S., U.S., EPT******” in the name column of the delegating, “B” in the name column, “B” in the name column of the delegating, and “B” in U.S., U.S., U., U.S., EPT******, the power of attorney forged, a private document signed by the Defendant on the rights and obligations of the Defendant, and exercised the forged power of attorney as if he had been actually an employee who was aware of the forgery in the name of document.
