A defendant shall be punished by imprisonment with prison labor for up to six months.

Punishment of the crime

1. Forging a private document;

A. On May 2012, the Defendant, using a computer in Guro-gu Seoul Metropolitan Transport Corporation C, located in Guro-gu Seoul Metropolitan Government, saying, “The Seoul Urban Railroad Corporation and the Trade Union, based on the working-level agreement between labor and management ( June 20, 2009), refers to the following: (D) a person in charge of the affairs of the Corporation for the financial independence of the trade union; and (e) a person in charge of the affairs of the Corporation, based on good faith, shall perform the following:

“1. The Corporation shall grant to a trade union the operating rights equivalent to 10% of its historical rental business (e.g., the existence of the year) planned and in progress in November 2009.

8.Each such letter may be notarized.

The phrase “E” shall be written in the column of the person in charge of the performance statement, stating “D” in the Seoul Special Metropolitan City Urban Railroad Corporation and the position column, and indicating “E” in the name column using the color pen and affix the seal arbitrarily affixed to the name.

Accordingly, for the purpose of uttering, the Defendant forged a letter of performance under the name of E, a private document on rights and obligations.

나. 피고인은 제 1의 가항 일시 및 장소에서 컴퓨터를 이용하여 ‘ 현금 보관 증’ 이라는 제목으로 “ 一金 : 貳億 四阡萬 원 整 (\ : 240,000,000)”, “ 상기금액을 정히 수령하고 위 금액의 보관을 확실히 하기 위해 이 증서를 작성하고 기명 날인 함( 보관 사유 : 서울도시 철도 공사 노동조합의 재정 자립을 위한 임대사업 준비 비) ”라고 기재하고, 보관자 상호 란에 “ 서울시 도시 철도 공사”, 직책 란에 “D” 이라고 기재하여 출력하고, 검은색 볼펜을 이용하여 성명 란에 “E” 이라고 기재하고 그 이름 옆에 임의로 새긴 E의 도장을 찍었다.

Accordingly, for the purpose of uttering, the Defendant forged a copy of cash custody certificate in the name of E, a private document related to rights and obligations.

2. On June 18, 2012, the Defendant’s exercise of the above investigation document written statements and performance, which were forged as above, at the Buddhist land.
