A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

2. 특수공무집행방해, 특수공용물건손상 피고인은 2019. 10. 1. 23:35경 광주 북구 F에 있는 G병원 앞 도로에서 위와 같이 술에 취한 상태에서 쏘나타 승용차를 지그재그로 비틀거리며 운전하던 중, 음주운전 단속을 하던 광주북부경찰서 H 소속 경감 I가 음주운전의 의심이 들어 신호봉을 크게 휘둘러 자동차를 일시 정지시키고 호흡조사를 요구하려 하는데도 현장을 그냥 지나치자, 위 사건발생 무전을 받은 위 경찰서 소속 경위 J은 K 순찰차에 탑승하여 위 승용차를 바로 뒤에서 추격하며 경광등을 켠 채로 사이렌을 울리고 정차요구 방송을 하였고, 경장 L은 M 순찰차에 탑승하고 피고인을 추격하였으나, 피고인은 이에 불응하여 도주하였다.
