Text

1. All of the plaintiffs' lawsuits against the defendant Minister of Education are dismissed.

2. The plaintiffs' claims against the defendant Institute of Korean Curriculum Evaluation and Planning are all dismissed.

3. The costs of lawsuit are assessed against the plaintiffs.

Purport of claim

On November 27, 2013, the Defendants issued the College College College College Test for the Plaintiffs on November 27, 2014 and revoked the determination of grade on global geographical subjects.

Reasons

1. Details of the disposition;

A. Pursuant to Article 34 of the Higher Education Act, Article 35 of the Enforcement Decree of the same Act, and Article 45(3)2 of the Regulations on Delegation and Entrustment of Administrative Authority, Defendant Korea Institute of Education (hereinafter “Korea Institute”) has performed the work of setting questions, printing, marking, giving notice of grade, formulation and implementation of a detailed implementation plan, etc., as entrusted by the Defendant and entrusted by the Minister of Education.

B. In November 7, 2013, 2014, an examinee passed the 600,000 qualifying examination. Of them, 37,684 examinees, including the Plaintiffs, selected a global efficience among the subjects of choice in the area of social search and inspection.

C. Following the completion of the examination, the Institute of Korea Institute of Education and Planning issued a correct response to the water-related test in 2014 by using the written response of the issue No. 8 of the World Geographical (hereinafter referred to as the “instant issue”) as “A” and “C (hereinafter referred to as the “instant fingerprint”), including the fingerprints of the instant issue, and the Plaintiffs did not mention the specific response of the instant issue in 2014. The content of the instant issue is as indicated in [Attachment 2” (hereinafter referred to as the “instant issue”), as indicated in [Attachment 2, the “(2012”) indicated on the right side of the map].

D. On November 13, 2013, some of the examinees who applied for the diversology of the diversity test filed an objection to the response of the instant issue on the ground that the fingerprint was not consistent with objective facts with the KET, and thus, the Defendant Institute of Education and Planning applied for a correct response to the instant issue on the ground that the fingerprint was a divers. On November 13, 2013, the Korea Institute of Education and Planning held a working committee for the examination of the objection and decided

E. On November 14, 2013, the Korean Institute of Economic and Geographical Education requested consultation on the question of this case, the meaning of indication of this year, and the authenticity of the fingerprints of this case. On November 15, 2013, the Korean Association of Economic and Geographical Studies and the Korean Association of Environmental Education present their opinions that there is no error in the fixed response of the problem of this case to the Korean Institute of Education. The major contents of the opinions of the Korean Association of Economic and Geographical Studies and the Korean Association of Environmental Education are as stated in the attached Table 3.

F. On November 18, 2013, the Korea Institute of Education and Planning decided that there is no error in the response to the instant issue, etc. by holding a review committee.

G. On November 27, 2013, the Korea Institute of Education and Planning of the instant case (hereinafter “instant disposition”), premised on the premise that the fixed response to the instant issue was ②, Defendant Korea Institute of Education and Evaluation, including the Plaintiffs, determined the grade of applicants for the water performance test in 2014, and notified the Plaintiffs of the results of the water performance test in 2014 (hereinafter “instant disposition”).

2. Whether the litigation against the defendant is legitimate;

In principle, an administrative litigation seeking the revocation of an administrative disposition must be the defendant with the administrative agency that conducted an administrative disposition under his/her external name, which is the subject of the lawsuit. On the other hand, the defendant education did not conduct the instant disposition against the plaintiffs. Therefore, the defendant of the lawsuit of this case seeking the revocation of the disposition of this case

Therefore, the plaintiffs' lawsuit against the defendant Minister of Education is unlawful.

3. Determination on the claim against the defendant Institute of Korean Curricula

A. The plaintiffs' assertion

(i) procedural defects;

Since the objection to the fixed answer of the instant issue is a serious objection, the Korean Institute of Curriculum should have received the objection to the fixed answer of the instant issue and immediately requested the relevant academic council to provide advice. However, on November 13, 2013, the Korean Institute of Curricula held a working committee for the examination of the instant issue without consultation with the relevant academic council to determine that there is no error in the fixed response of the instant issue, and requested consultation with the Korean Association of Economic Geographical Studies and the Korean Association of Environmental Education only after making the aforementioned decision. In addition, the Korean Institute of Curriculum decided on the objection to the fixed answer of the instant issue without holding the deliberation committee on the objection to the serious issue.

Therefore, the instant disposition is unlawful on the ground that procedural defects exist.

2) An error in the instant issue

The fingerprints in this case seems to mean the total production amount of the European Union (EU, the EU) and the North America Free Trade Agreement (NAFTA), as seen in paragraph (d) of the same Article, without presenting the comparison point, even though it is compared with the total production amount of the European Union (Nros Dos Does Do Do Do Do Do Do dP). Thus, the total production amount is not a domestic total production, a national total production (Gros NNP, GNP), or a national total income (Gros Nals Nalcom, GNI), and if the fingerprints in this case was based on the general tendency or trend of the total production amount of the European Union and North America Free Trade Agreements, there is no significant error in terms of the following: (a) the fingerprint in this case does not have any expression such as “alternative or tendency” in itself; (b) the total production amount is not a national total production or a national total production (Gros NNP); and (c) the fingerprint in this case does not have any expression such as this case.

In addition, the fingerprint of this case did not present the necessary comparison point in comparison with the total production amount. Considering that the map included in the issue of this case is indicated in the year of 2012, the map Nos. 4, 5, and 14 of the 2014, and the issue Nos. 11, 13, 14, 18, 19, and 20 of the Republic of Korea (attached Form 4, the same shall apply to the description of the global geographic and Korean geographic issues) should solve the problem on the basis of the year indicated in the picture, the time when comparing the total production amount of the Free Trade Agreement with the European Union should be 2012 years in accordance with the marking of the year of this case, since the total production amount of the North America Free Trade Agreements is larger than the total production amount of the European Union, the fingerprint of this case is objectively clear.

The World Geographical Subjects include the total production amount of the European Union and the North America FTA as of 2007, and do not reflect objective facts that the total production amount of the North America FTA was higher than the European Union since 2010. Even though textbooks are written differently from objective facts, it does not fit the purpose of education of high school curriculum and normal global geographicism. For the purpose of waterway tests, examinees must study current topics in addition to textbooks. In fact, when the Free Trade Agreement is concluded in Korea, China and Japan, it is necessary to study current topics in addition to textbooks, and if the economic scale of the North America FTA was higher than the European Union due to the financial crisis of the European Union, it is natural that they can easily understand the implications that the number of examinees could easily have been compared with the objective facts through newspapers and broadcasting.

Considering the above circumstances, this case’s fingerprint cannot be a correct fingerprint, and accordingly, it cannot be a correct answer to the issue of this case’s fingerprint (2). Therefore, even though the issue of this case ought to be deemed to have no correct response, the disposition of this case by the Korea Institute of Education and Planning, which decided the global rating of the plaintiffs, is unlawful.

B. Facts of recognition

The following facts can be acknowledged in full view of each evidence, evidence No. 4, evidence No. 6-1, evidence No. 6-2, evidence No. 8, evidence No. 1, evidence No. 2, evidence No. 2, evidence No. 6, evidence No. 7-1, and evidence No. 7-3, and the whole purport of argument No. 7.

1) High school curriculum

The “elementary and Secondary School curriculum” (amended by the Ministry of Education, Science and Technology No. 2009-41, Dec. 23, 2009) contains the following contents as to the global curriculum of high school.

(c) to seek a path for inter-regional cooperation and mutual respect, and to understand and resolve conflicts and disputes between regions. (6) to understand changes in the world economic environment, such as economic block and free trade agreements, and to understand conflicts and mutual respect among the countries, regions, and residents surrounding it.The evaluation is conducted on May 1, 200: The evaluation is conducted in a comprehensive way beyond the basic direction for presentation of basic principles, the concept of understanding and understanding of the concept and attitude of regional knowledge and value, and the comprehensive understanding of the concept and degree of understanding of new knowledge and value in the region.

2) Master plans, etc. to conduct the 2014 Do 2014

B) The fixed response rate of the instant issue was 49.89%. The fixed response rate by grade for the instant issue was 100%, 2nd class 91%, 3rd class 80%, 4th class 64%, 5th class 47%, 6th class 29%, 7th class 18%, 8th class 12%, and 9th class 7%.

4) Contents of the High School Global Textbooks

Textbook (225 pages) stating that “When Korea, Japan, and China enters into a free trade agreement, it is anticipated that Korea, and China will be injured to the world-wide integrated market following the World Trade Agreement, North America, and the three major economic sphere will be reached.” The maps indicated together with the above contents state USD 18,387 billion, and the total production amount of the European Union was expressed as USD 16,467 billion, based on the international statistical reduction in statistics in 2009, and USD 16,467 billion.” The World Geographic Textbook (125 pages) stating that “The Rotterdam is an official book of the European Union, which is the largest market in the world-wide world-wide.” The contents of each textbook are as follows:

C. Determination

1) Determination of procedural defects

The Native Test Master Plan states that “The relevant academic council (or external experts) shall be requested to provide advice on serious matters (including questions, answers errors, and questions likely to violate the curriculum) from the time of receiving the objection, and in the case of serious matters, at least three external experts who are not members preparing the objection shall be present at each area, and, if necessary, the relevant academic council (or external experts) shall be requested to provide advice.” According to the Native Test Plan, upon receipt of an objection, the Native Examination Working Committee shall classify the matters raised by the Native Committee as simple and important matters, and classify the matters raised by the objection as an important matter, and determine the response details of the objection, and then refer the important matters to the Committee, and thereafter, the Committee shall be held to deliberate and confirm the matters determined by the E-Examination Working Committee, and the matters referred to as an important matter shall be dealt with.

On the other hand, the following circumstances, which are acknowledged by comprehensively taking into account the aforementioned facts and the purport of the entire arguments, i.e., the Korea Institute of Education, the Evaluation, the Institute of Education, the Korea Institute of Education, and the Korea Institute of Education, decided to the effect that there is no error in the response to the instant issue, etc., and ii) the final decision on the objection to the objection to the question is an objection that is not the working committee for the examination. Therefore, the plaintiffs' above assertion is without merit.

2) Determination as to the error of the instant issue

In general, the preparing commissioner who prepares an examination as an administrative act shall have discretion in the sense that he/she can freely determine what kind of matter is within the scope of the statutory provisions and what terms and forms of questions and answers to be made within the scope of the statutory provisions. However, since the discretion has an inherent limit to be exercised properly in the contents and composition of the preparation so that he/she can assess the ability of the examinees in accordance with the purpose of the examination, the act of preparing questions shall be illegal if the exercise of its discretion exceeds the limit.

On the other hand, in the preparation of a multiple-choice issue, the selection of the text composition or expression terms in the text form or answer form has been wrong, and as a result, an average level of examinees are made unable to choose a legitimate answer port, it may be deviation from or abuse of discretionary power. However, if the examinee at an average level is at the degree that he/she does not interfere with the grasping of the genuine intent of the multiple-choice questions and the selection of the answer form through the comprehensive analysis and analysis of the method of preparation of the multiple-choice answer form or the entire text and answer form, he/she shall not be deemed deviation or abuse of discretionary power unless there are special circumstances

In this case, in light of the following circumstances, the aforementioned facts and evidence Nos. 8-1 through 4, Eul’s evidence Nos. 9-1 through 3, and the overall purport of the arguments and arguments, it cannot be deemed that even if the fingerprints of this case is either vague or unclear, it cannot be deemed that the average level of examinees did not choose the response of the problem of this case. Thus, the setting of the issue of this case cannot be deemed unlawful as it deviates from or abused discretion. Accordingly, the plaintiffs’ above assertion is without merit.

A) Of the issue of this case, “1” fingerprints appears to be “(1) that the foreign capital investment in Mexico has increased rapidly as it appeared in the North America Free Trade Agreement.” Inasmuch as the foreign capital investment in Mexico has been concluded, it is obviously correct to fingerprints. Inasmuch as fingerprints is considered to be subject to joint customs duties outside the territory of the European Union and the North America Free Trade Agreement, and the North America FTA does not impose any customs duties outside the territory, so it is clearly solid fingerprints.” The “4” fingerprint is considered to be of high importance than the total amount of trade outside the European Union, and the European Union is of high importance, so it cannot be seen that the percentage of this case’s fingerprints was clearly amper than that of the North America Free Trade Agreement. Therefore, considering the circumstances seen in the following (b) through (d) the 4th answer to this case’s fingerprint, it cannot be seen that the 9th answer to this case’s fingerprint, which is obviously legitimate and unreasonable, including the “1st answer to this case’s fingerprint,” and thus, it cannot be seen that the 4th answer to this case’s answer to this case’s answer.

B) Since the fingerprints of this case is “the European Union has a large total production amount than the North America FTA,” there is unclear point as to which time the total production amount should be compared. However, in light of the global Geographical Subjects adopted in the process of high school subjects, “it is anticipated that if Korea, Japan and China enter into a free trade agreement, it will be injured to the world-wide integrated market following the Free Trade Agreement, North America, and the world-wide 3 economic sphere (school affairs world book)” or “Irrhian as the official book of the European Union, which is the largest market in the world-wide,” and it is difficult to conclude that the total production amount of fingerprint of this case can not be seen as the average production amount of fingerprint from 20 years to 10 years from the date of the production of the textbook of this case, even if it is no more than the average production amount of fingerprint from 20 years from the date of the production of the textbook of this case.”

C) ① As the map indicated on the issue of the instant case has indicated the pertinent year, the fingerprint of the instant case may be interpreted as fingerprinting whether the total amount of production in any region of the European Union and the North America Free Trade Agreement exceeds the total amount of production as of the year 2012. We examine whether such interpretation ought to be made.

② Of the instant issues, “A”, “B”, and “Div” fingerprints are not fingerprintss that can determine right and wrong based on the 2012-year indication in the instant year. “A” fingerprints is at the time of the conclusion of the North America Free Trade Agreement (2012), and is always molded regardless of the 2012-year period.

③ We examine the cases of other issues in global geographical examination. As such, it is not an issue of asking whether all the above data are aware of the statistics in 2010. According to the waterway test basic plan, the purpose of providing hydro-high school curriculum is to measure the ability of education necessary for university education and to prepare a screening data in line with the level and content of high school curriculum, to contribute to the normalization of high school education and to provide them with high school fairness and objectivity, and to understand the concept and ability of study in the world as well as to understand the concept and ability of study of high school in accordance with the basic principles that can be compared with the basic principles of high school curriculum in order to contribute to the normalization of school education, and to understand the concept and ability of study in the world as well as to understand the scope of study.

(6) Of the instant issues, three fingerprintss, other than the fingerprint of this case, are fingerprintss that can be judged as correct regardless of the year 2012, regardless of whether they can be compared with the year indicated in the guidance, and it is difficult to view it as a matter of examining whether specific statistical values and comparisons can be made by comparing with those of other issues of the global geographic and Korean Geographicalties with the year indicated in the guidance. Considering the purpose of education at high school global geographicism, it is an exceptional point of view that setting up the problem of comparing the latest economic statistics that are not attributable to textbooks in the global geographical subject of the able testing is not written in the instant fingerprint of 2012, but rather, indicating the “(2012)” at the right side of the instant issue as of the date indicated in the direction of the instant case, it cannot be said that the instant fingerprints of the European Union and North America Free Trade Agreements should be interpreted as fingerprinting as 2012.

D) It is difficult to view that there is no evidence suggesting that only the “total production amount” is a domestic total production or a national total production, and that the above “total production amount” is not clearly defined (in light of the language of the “total production amount, it is difficult to view that there is a possibility that examinees might mislead the total production amount as a national total income). However, in light of the purpose of education at high school world, it is difficult to view that: (i) the accurate understanding and definition of economic terms in the subjects; and (ii) the difference in statistics in a specific region in relation to such terms is difficult to view that education is conducted in a specific region; (iii) there is no evidence suggesting that the “total production amount” of the fingerprints in the instant case is a domestic total production or a national total production; and (iii) the Plaintiffs are asserting that the “total production amount” in the instant lawsuit is a domestic total production or submission of materials related to the domestic production; and (iv) it is difficult to regard that the fingerprints in this case’s fingerprint is a national total production or a national total production machine.

However, it is not only likely to impede the normalization of high school education, but also is also inconsistent with the purpose of measuring the ability of education necessary for university education and providing a fair and objectivity screening data.

4. Conclusion

Therefore, the plaintiffs' lawsuits against the defendant Minister of Education are dismissed in its entirety as it is unlawful, and the claims against the defendant Institute of Korean Curriculum Evaluation and Planning are dismissed as it is without merit. It is so decided as per Disposition.
