The defendant shall be innocent.

The facts charged of the instant case (Article 14 of the Inventory of 2017 resident stay support at the Daegu District Court; Article 2008 high court resident stay support at the Daegu District Court 803 high court 2008 high court 803) shall be punished by a fine under Article 86 and Article 83 (1) 2 of the former Road Act (wholly amended by Act No. 7832 of Dec. 30, 2005) (wholly amended by Act No. 8976 of Mar. 21, 2008) of the relevant Constitutional Court 208Hun-Ga decided July 30, 2009 by the ruling of Article 86 of the said Act where a corporation’s agent, employee or other worker commits a violation under Article 83 (1) 3 of the said Act in connection with the business of the corporation.

“The portion of the above facts charged is unconstitutional and thus the penal provision on the above facts charged becomes retroactively null and void. It is not guilty in accordance with the former part of Article 325 of the Criminal Procedure Act as it does not constitute a crime.
