Reasons
Punishment of the crime
[criminal record] Defendant E was sentenced to a suspended sentence of six months of imprisonment with prison labor for a crime of re-election of electronic records, etc. at the Suwon Friwon on November 5, 2015, and the judgment becomes final and conclusive on November 13, 2015, and is currently in the grace period.
[Criminal facts]
1. Defendant A: (a) around 05:00 on February 6, 2017, at “H main points located in Gangnam-gu Seoul, Seoul, the Defendant stolen: (b) committed a theft with approximately KRW 800,000 mobile phone at the market price located in the victim’s back part; (c) from October 31, 2016 to February 6, 2017, the Defendant stolen 89 mobile phone owned by the victims of approximately 7,636,00 won in total over 89 times, including the content of Table 1 of the List of Crimes.
2. Defendant B: (a) around 09:00 on January 12, 2016, the thief: (b) around 09:0, the Defendant: (c) committed theft with approximately KRW 830,00 of the market price at which the victim’s L was left away; (d) from September 2, 2016 to February 2, 2017, the Defendant stolen 17 mobile phones owned by the victims of approximately KRW 1,5320,00 in total on 17 occasions, as in the list 2 of the crimes committed in the attached Form.
3. Defendant C: around October 14, 2016, the Defendant purchased 60,00 won a mobile phone owned by the victims from the above “K station,” and acquired 60,000 won of the victim’s mobile phone in the name of the stolen victim from the above B, from October 2016 to February 3, 2017, the Defendant purchased 60 cell phone owned by the victims on a total of 26 occasions, such as the list 3 of the crimes committed.
4. Defendant D: around December 30, 2016, in the vicinity of the subway station located in Gangnam-gu Seoul, Gangnam-gu, Seoul, the Defendant purchased five mobile phones from the victims of thefted names in the amount of KRW 2.70,00,00,00 from around October 10, 2016 to February 4, 2017.
