A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

No one shall photograph another person's body, which may cause any sexual humiliation or sense of shame, by using a camera or any similar mechanism, against the latter's will, or distribute, sell, lease, provide, openly display or screen such photographed objects, or distribute, sell, lease, or openly display any obscene codes, words, sound, image, or motion picture through an information and communications network.

1. A crime committed against the victim's name and injury B;

A. A. Around August 7, 2013, the Defendant, at a place where the location is unknown on August 7, 2013, the Defendant taken three-time images of the victim’s sexual organ while the victim (one-time female victim B) was locked by using the Defendant’s smartphone.

Accordingly, the defendant taken the body of a person who may cause sexual humiliation or shame by using a mechanical device with a camera function against his will.

B. On August 22, 2018, around 04:50 on August 22, 2018, the Defendant sent three copies of a photograph taken under the title “D”, i.e., “D” on the bulletin board, and posted three copies of a photograph taken under the title “D”.

As a result, the Defendant openly displayed photographs taken against another person’s body, which may cause sexual humiliation or shame, using a camera or similar mechanism, and displayed obscene images openly through information and communication networks.

2. The Defendant committed the crime against the victim E, around 06:40 on July 18, 2017, when the victim E (n.e., women and 36 years of age) using the Defendant’s smartphones, taken twice the sexual part of the said victim’s sexual organs from the above date to February 5, 2018, and the victim was 56 times in total, as indicated in the list of crimes committed.
