Defendant shall be punished by a fine of KRW 5,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

1. On March 2014, the Defendant forged private documents: (a) removed labels attached to the sampling column of the test report issued by the Director of the Testing and Research Institute of “FITI”, which was kept in the “D” office of the Defendant’s operation in Dongdaemun-gu Seoul, Seoul, and made eight copies of the test report by attaching “D” labels to that page.

Accordingly, the defendant forged 8 copies of the test report, which is a private document concerning the certification of facts in the name of the Director of the Research and Research Institute.

2. On March 2014, the Defendant: (a) sold a number of false test results to G, H, I, J, K, L, M, or N in the public relations officials of “F” located in Sungsung-gun, Sungsung-gun, M, and (b) presented them to the above-mentioned persons who are aware of the fact as if they had completed the forged test results as described in paragraph (1); and (c) issued them a number of forged test results.

Accordingly, the defendant exercised 8 copies of the FITI test report in the name of the Director of the Testing and Research Institute.

3. The defrauded presented the results of the test under Paragraph 2 to the victim G, H, I, J, K, L, M, and N at the time, place, as described in Paragraph 2, that “this product is the highest product that has undergone a test on the product at the Ethti (FIT) testing institute.”

However, the test results attached to the number as stated in Paragraph 2 were forged, and there was no examination of the Ethti (FIT) testing institute.

The defendant sold the number of money to 8 persons, including the victim G, to 1,280,00 won per opening, and received the money.

Accordingly, the defendant, by deceiving the victims, received the total amount of KRW 1,024,00 from the victims and fraudulently acquired them.
