[Judgment of the court below] Defendant A is the representative of the O childcare center located in Suwon-gu N, Suwon-si, and Defendant B was registered as the principal of the above O childcare center from May 2, 2005 to July 14, 2013. Defendant C was the person who served as the principal of the above childcare center from July 15, 2013 to April 2014.

【Criminal Facts】

1. Defendant B - No person who is named the principal of a child-care center shall have him/her carry out the duties of the principal of a child-care center;

The defendant did not work as the principal of the above child-care center from around June 25, 2012 to June 25, 2013, and even though C had served as the principal of the above child-care center during the above period, the defendant was working as the principal of the above child-care center and was paid KRW 18,00,000 per month in total as the subsidies from the State for the head of the child-care center.

Accordingly, the defendant used his name to carry out the duties of the director of the child care center.

2. Defendant A and Defendant C

(a) No person who borrowed the name of the principal of a child-care center from another person shall conduct the duties of the principal of a child-care center;

The Defendants conspired to make the registration of B as the head of the above child care center as described in the above paragraph (1) and the fact that B had been registered as the head of the above child care center was the actual role of the head of the above child care center from around 2012 to June 25, 2013, but the Defendants continued to perform the duties of the head of the above child care center for the above period.

As a result, the Defendants conspired to lend the name of the above B to Defendant C to carry out the duties of the head of the above child care center.
