Defendant
A and B shall be punished by a fine of KRW 1.5 million, and Defendant C shall be punished by a fine of KRW 4 million.
The Defendants respectively.
Reasons
Punishment of the crime
Defendant
A is the name of the F Child Care Center E in the Gu and the name of the “H Child Care Center” in the Gu and the name of the “H Child Care Center” in the Gu and the actual president of the “F Child Care Center” and “H Child Care Center”.
The head of a child-care center shall not allow another person to perform the duties of the head of a child-care center by using his/her name or the name of the child-care center, or shall not lend his/her certificate of qualification to another person, or shall not be the other party to such
1. Defendant A: (a) from March 2, 2012 to February 25, 2014, to receive KRW 300,000 per month from the above F Child Care Center; and (b) C directly performed the duties of the above Child Care Center, such as the management of children, infant care teachers, and counseling of child guardians, and (c) performed the duties of the director of the Child Care Center by using his name to C; and (d) leased the director’s license to C.
2. Defendant B, from December 1, 201 to March 4, 2014, to receive KRW 300,000 to KRW 600,00 per month from H childcare centers, and Defendant B, from March 3, 2014, to receive KRW 300,00 per month from C, and Defendant C directly performed duties such as management of the above childcare center, management of infant care teachers, counseling of child care guardians, etc., and provided C with the child care center’s license by using his name, and leased the child care center’
3. Defendant C
A. The Defendant became the other party to the lending of qualification certificate by borrowing the name of the head from A to practically performing the duties of the head of the childcare center, at the time and place specified in paragraph (1). 2) The Defendant became the other party to the lending of qualification certificate by borrowing the name of the head from B, such as the date and place specified in paragraph (1) 1, at the same time and place specified in paragraph (2) 2.
B. On February 2014, the Defendant received the subsidy at the F Child Care Center.
