The defendant shall be innocent.
Reasons
1. On May 6, 2008, the summary of the facts charged, asserting that “the phase-out expansion agreement on the import of U.S. beef concluded with the Government of the Republic of Korea on April 18, 2008 is a stroke negotiation, as well as a result undermining the citizens’ health rights” was organized by the National Countermeasure Committee against the full import of U.S. beef from the U.S. (hereinafter referred to as the “Countermeasures Committee”).
Since May 2, 2008, the countermeasures conference led to a candlelight assembly against the import of U.S. beef in Jongno-gu Seoul, Jongno-gu, Seoul, following the candlelight assembly, which was held from May 6, 2008. On the first day, the party meeting held from the Cheong River that held the candlelight assembly, which is an outdoor assembly after sunset. From May 24, 2008, since the candlelight assembly was held every day, the party tried to enter the Cheong River with the road located in the city, such as Sejong-ro, paper, newspaper, etc. after the candlelight assembly was held every day.
On June 2, 2008, the Government announced the "Reservation for Publication in the Official Gazette". However, the Countermeasures Council decided to hold the "National Action for 72 hours dedicated to the complete renegotiation of the withdrawal of the announcement from June 5, 2008 to June 8, 2008 in order to encourage the withdrawal of the notification of the import sanitary requirements for U.S. beef and the full renegotiation of the import extension agreement for U.S. beef."
Accordingly, on June 6, 2008, from around 19:00 to 20:30, the countermeasures conference stated that approximately 45,000 persons are "public flag, beef import opposition" on the front side of the Korean Council, front of the Seoul Metropolitan Council, front of the Flason hotel, front of the flason hotel, and front of the luminous building, after installing flag cards, flag cards, two side of the stage vehicles, and power-driven vehicles, etc., stating that "Isleners or flags, E, citizen's opposition, and citizen's opposition to the determination of a crime."
