1. Of the land size of 198 square meters and the above I rent 201 square meters to the Plaintiff (Counterclaim Defendant)
A. The Defendant (Counterclaim Plaintiff) B is the Plaintiff.
Reasons
A principal lawsuit and a counterclaim shall be deemed simultaneously.
1. Basic facts
A. On January 21, 1967, the land number was changed to the above H on February 16, 1979 and the land classification was changed to February 16, 197. The land before subdivision was completed by M on February 27, 1929. Each ownership transfer registration was completed in the name of R on March 30, 1968 through N,O, P, Q, and Q as of March 30, 1968. On February 25, 1970, the ownership transfer registration shares of S with respect to one-half of the above land were completed on February 25, 1970, and the ownership transfer registration was completed again on March 6, 1987.
B. On March 29, 1976, T has completed the registration of ownership transfer in the name of O on the instant H land by forging the registration-related documents with an O, its own owner, and thereafter, on the instant H land as of June 29, 1976, T has completed the registration of ownership transfer to T with the head of Suwon District Court Branch No. 11702 on September 27, 1978 as of the receipt of the same registry office as of September 27, 1978, as of the Republic of Korea District Court No. 41092 on July 25, 1979, with the head of 10850 on the receipt of the same registry office as of July 25, 1979, and as of March 9, 1981, the registration of ownership transfer has been completed to Defendant B with the same registry office No. 5078 on March 9, 198.
C. R, which became aware of the existence of a double land register on the H land of this case, filed a claim suit, such as cancellation of registration of preservation of ownership, etc. with Suwon District Court Incheon Branch 81Ra1375, and rendered a judgment on March 9, 1981, “Defendant B shall cancel the registration of transfer of ownership, which was completed by Suwon District Court 5078 on the H land,” and the registration of transfer of ownership was closed at the same time as the registration of ownership and the registration of transfer of ownership are cancelled on October 17, 1983 by the above judgment.
T shall be 46.28 square meters in the instant W land around 1966.
