A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2020. 5. 12. 04:15경 제주시 B 앞 도로에서 “술 취한 남자와 시비 중이다.”라는 내용의 112신고를 받고 출동한 제주동부경찰서 C지구대 소속 순경 D(23세)이 사건 경위를 청취하려고 하자, “내가 뭘 잘못했냐. 경찰새끼들이 법을 알고는 하는 거냐. 멍청하니까 경찰이나 하는 거다. 이 씨발 놈들 꺼져. 씨발놈아, 좆같은 경찰. 씨발새끼.”라고 큰소리로 욕설을 하면서 피고인의 휴대전화기를 순찰차를 향해 집어 던지고, 팔을 D의 목을 향해 휘두르는 등 D을 위협하고, 손바닥으로 D의 손등을 때리는 등 D을 폭행함으로써 경찰관의 사회공공의 질서를 유지하기 위한 정당한 직무집행을 방해하였다.
