A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2020. 6. 6. 18:00경 술을 마신 상태로 제주시 B에 있는 C의 집에 갔다가 C가 문을 열어주지 않는다는 이유로 현관문을 발로 걷어차 현관 유리창을 깨뜨리는 등 행패를 부리다가 C의 112신고를 받고 출동한 제주동부경찰서 D지구대 소속 경찰관 순경 E(26세)으로부터 제지를 받으며 위 집에서 퇴거할 것을 요청받았음에도, 이에 불응하면서 “내가 무슨 죄를 지었냐. 나 집에서 안 간다. 그럼 수갑을 채워라. 일대일로 맞짱을 뜨자.”라고 말하며 손으로 E의 멱살과 우측 견장을 잡고, E의 다리를 걸어 넘어뜨리려고 하는 등 E을 폭행하여 112신고 출동을 통한 범죄의 예방 및 진압에 관한 경찰관의 정당한 직무집행을 방해하였다.
