Criminal facts

On February 12, 2019, Defendant 2019, 96 and the person subject to a request to attach an attachment order (hereinafter “Defendant”) concluded a lease agreement with the victim B (the age of 61) on the Category D of the Pyeongtaek-si Building C, with a deposit of KRW 1 million and KRW 300,000,000,000 per month. On February 12, 2019, the lessee did not have a specific occupation while residing in the above Category D, and the lessee did not have a specific occupation and did not pay monthly rent from May 12, 2019.

On June 26, 2019, at around 21:00, the Defendant, at the second floor of the above C building, entered the victim waiting for the Defendant into the above C building D, urged the victim to pay unpaid monthly rent, and received a statement from the victim that “I need to clean or adjust because I do not need to do so.” The Defendant, after hearing the victim’s desire for the Defendant’s parents, was able to kill the victim.

이에 피고인은 위 방 안 씽크대 칼꽂이에 있는 흉기인 식칼(총 길이 34cm, 칼날길이 22.5cm)을 꺼내 오른손에 쥔 후, 위 D호에 대한 월세계약서를 보기 위해 뒤돌아 서 있는 피해자의 뒤로 다가가 피해자의 좌측 목을 1회 찌르려고 하였으나 빗나가 피해자의 왼쪽 어깨 부분을 1회 찌르고, 계속하여 피해자의 후두부 및 좌측 목을 각각 1회 힘껏 찔러 피해자에게 머리 후두부의 찔린 상처(길이 약 6cm, 깊이 약 9cm, 왼척추동맥 및 목뼈 1-2번 절단) 및 좌측 목 부위의 찔린 상처(길이 약 6cm, 깊이 약 9cm)를 가하고 2019. 6. 26. 21:37경 피해자가 E병원으로 후송되던 중 머리 목 부위 자상으로 인한 저혈량 쇼크사로 사망에 이르게 하여 피해자를 살해하였다.
