A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

1. 특수협박 피고인은 2019. 5. 27. 20:15경 서울 동대문구 C건물 4층에서, 그 곳 D호에 거주하는 피해자 E(38세)의 가족이 바닥을 뛰어다니고 망치로 바닥을 쿵쿵 쳐 소음을 발생시켰다는 이유로, 자신의 집에 있던 위험한 물건인 몽둥이 모양의 긴 원통(길이 약 75cm, 지름 약 5cm)과 식칼(칼날 길이 약 21cm, 총 길이 약 33cm)을 들고 D호 출입문 앞으로 가 초인종을 누르고 위 원통으로 벽을 치며 피해자를 위협하였다.

Accordingly, the defendant had dangerous objects and threatened the victim.

2. 공무집행방해 피고인은 2019. 5. 27. 20:50경 제1항 기재 'C건물' F호에서, '위층에서 망치로 바닥을 쿵쿵 치는 소리가 들린다'라는 피고인의 112신고를 받고 출동한 서울동대문경찰서 G파출소 소속 경위 H으로부터 층간소음을 대화로 처리하라는 말을 듣자 화가 나 H의 얼굴을 손으로 치고 몸을 밀어 넘어뜨렸다.

Accordingly, the defendant assaulted H and interfered with the legitimate execution of duties by police officers on handling 112 reported cases.
