Reasons
Punishment of the crime
The defendant is not a person handling narcotics.
1. Violation of the Act on the Control of Narcotics, etc. (fence) - Trading point;
A. At around 22:00 on the first day of October 2017, the Defendant: (a) received KRW 300,000 in cash from D in front of the gas station located in Gangdong-gu Seoul Metropolitan Government; and (b) Metepiced approximately 0.5g of psychotropic drugs, which are contained in the one-time injection machine (hereinafter “philopon”).
Accordingly, the defendant purchased and sold philophones.
B. On October 26, 2017, at the same place as the preceding paragraph at around 22:10 on October 26, 2017, the Defendant received 300,000 won in cash from D and gave 0.5g of philophones contained in the one-time injection machine to him.
Accordingly, the defendant purchased and sold philophones.
2. Violation of the Act on the Control of Narcotics, etc. (flavoring) - The Defendant received approximately 0.5g gramphones contained in the one-time injection machine from G within the house of Gangdong-gu Seoul Metropolitan Government EtelF on June 30, 2018.
Accordingly, the defendant accepted philophones.
3. Violation of the Act on the Control of Narcotics, etc. - Medications;
A. The Defendant, around June 30, 2018, injected approximately 0.03gopon in the house of the above G, in a single-use injection machine, and injected it with water into the Defendant’s body.
Accordingly, the Defendant administered philophones.
B. The second criminal defendant administered approximately 0.03 grams of philophones in the same place as that of the preceding paragraph at around 23:00 on the same day, and in the same manner as that of the preceding paragraph.
4. The Act on the Control of Narcotics, etc. (flavoring) - the Defendant was carrying approximately 0.21g of philophones contained in vinyl packaging in his house around 08:48 on July 3, 2018.
Accordingly, the defendant possessed a philophone.
