1. The Plaintiff:
A. As to Defendant limited partnership C and D’s joint and several KRW 77,057,937 and KRW 23,489,742 among them, Defendant limited partnership companies and D’s joint and several liability.
Reasons
1. Facts of recognition;
A. F Co., Ltd. concluded a credit transaction agreement with Defendant Limited Partnership C (hereinafter “Defendant Company”) as the primary debtor and with the remaining Defendants, G, and H as joint and several sureties, as indicated in the attached Form.
B. On June 29, 2006, I limited liability company received the claim for the instant loan from F Company F, and on November 2, 2006, filed a lawsuit against the Defendants, G, and H by filing a claim for the amount of transfer under Seoul Central District Court 2006Gahap9323, September 14, 2007, with the Plaintiff:
A. The defendant company's 199,63,388 won and among them (1) 27,409,869 won per annum from September 16, 2006 to August 11, 2007; 20% per annum from the next day to the day of full payment; 22,016,262 won per annum from September 16, 2006 to the day of full payment; 3) 100,000,00 won per annum from September 16, 2006 to the day of full payment; 20% per annum from the next day to the day of full payment; and 3) 10,000,00 won per annum from September 16, 2006 to August 11, 2007 to the day of full payment; and
B. Defendant G, D, and H jointly with the Defendant Company an amount of KRW 38,304,977 out of KRW 199,663,388 as stated in the above paragraph (a) and KRW 23,960,147 out of these amounts, 19% per annum from September 16, 2006 to August 11, 2007, and 20% per annum from the next day to the date of full payment;
C. Defendant G and H jointly and severally with the Defendant Company 7,820,154 of the KRW 199,63,388 of the above paragraph and 3,49,722 of the above paragraph, 199,663,38 of the amount calculated by the rate of 19% per annum from September 16, 2006 to August 11, 2007, and 20% per annum from the next day to the date of full payment;
D. Defendant G and H shall, jointly with the Defendant Company, be paid an amount of KRW 4,459,897 out of KRW 199,663,388 as stated in the above paragraph (a) and an amount of KRW 2,016,262 per annum from September 16, 2006 to the date of full payment, within the limit of KRW 39,00,000,000;
E. Defendant G and H jointly and severally with the Defendant Company 123,142,136 of the above paragraph (a) and 100,000,000 won among them, 199,663,388 won per annum from September 16, 2006 to the day of full payment.
