[2012고단8803] 피고인들은 Q 일행과 2012. 2. 26. 04:30경 인천 남구 R 앞 도로에 있는 포장마차에서 피해자 S(여, 20세)으로부터 어깨가 부딪쳤다는 이유로 “아 씨발”이라는 욕설을 하였다가 피해자 S과 그녀의 일행인 피해자 T(29세)으로부터 사과를 요구받자, 피고인 M은 손으로 피해자 T의 멱살을 잡아 흔들고, 주먹으로 얼굴을 수 회 때리고, 피고인 A은 주먹으로 피해자 T을 수 회 때려 그곳 바닥에 넘어뜨린 후, 넘어져 있는 피해자 T을 수 회 발로 걷어차고, 이를 제지하는 피해자 P(30세)의 얼굴을 주먹으로 1회 때려 그곳 바닥에 넘어뜨린 다음 피해자 P을 수 회 발로 걷어찼다.

M은 피해자 S에게 붙잡히자 주먹으로 그녀의 얼굴을 수 회 때려, 그곳 바닥에 넘어뜨린 후 넘어져 있는 피해자 S을 수 회 발로 찼다.
