Punishment of the crime

1. A은 위와 같이 피해자와 몸싸움을 벌이다가 위 음식점 옆에 있던 ‘I 주점’ 앞 도로 쪽으로 이동하던 중 재차 화가 나, 피해자의 몸을 붙잡고 피해자를 바닥에 넘어뜨린 뒤 바닥에 뒹굴며 몸싸움을 벌이고, 옆에 있던 피고인 B는 피해 자가 싸움을 말리는 자신의 얼굴 부위를 팔꿈치로 1회 때렸다는 이유로 화가 나, 피해자를 일으켜 세운 뒤 손으로 피해자의 얼굴 부위를 수 회 때리고, 이어서 팔로 피해자의 목을 휘감아 잡은 뒤 피해자를 재차 바닥에 넘어뜨리고, 그 옆에 있던 피고인 A은 주먹으로 피해자의 머리와 몸통 부위를 수 회 때리고 발로 피해자의 다리 부위를 밟고, 피고인 B는 잠시 후 피해자가 일어나자 재차 팔로 피해자의 몸을 붙잡은 뒤 피해자를 바닥에 넘어뜨렸다.
