Reasons
Punishment of the crime
1. Forgery of private documents and the display of private documents;
A. On June 24, 2016, the Defendant stated in the form of a real estate lease contract (lease) on the land for the purpose of exercising at the Defendant’s house located in the Busan B, the following: “The KRW KRW,00,000,000,000 on April 23, 2015, the lease period of April 23, 2015, and 24 months from April 23, 2015, the lease date C, and April 3, 2015 on the contract date,” and submitted one copy of the C’s private document on the rights and obligations (lease) lease contract, which is a private document on the rights and obligations, with the seal affixed at the discretion of the Defendant’s house located in the Busan, Busan, the Defendant forged one copy of the C’s private document on the land lease contract (Lease) contract, which was forged as above, as a security document, as if it was duly concluded
B. On April 13, 2017, the Defendant stated in the form of a real estate lease contract for the purpose of exercising at the above Defendant’s house the following: “A real estate lease contract for the purpose of extending the real estate lease (lease) by April 23, 2017 to April 22, 2019 (24 months),” and stated in C’s name, a copy of the private document on the rights and obligations, which is a private document on the date of the lease (Lease), shall be forged by affixing a seal affixed thereto at his/her own discretion, and on the same day, submitted a forged real estate lease contract for the said real estate lease (lease) as a security document as if it was duly formed by obtaining an extension of the loan period from D and E, respectively.
2. On June 24, 2016, the fraud Defendant: (a) obtained a loan under the condition that “the maximum loan amount of KRW 10 million, interest rate of KRW 27.9%, and March 31, 2017 from June 24, 2016,” respectively, from the victim Co., Ltd. D and the victim Co., Ltd. E via telephone; and (b) obtained a loan from June 24, 2016, from June 24, 2016 to March 31, 2017 as the expiry date of the loan; and (c) entered into a real estate lease agreement as “the deposit amount of KRW 50 million, and
