1. All of the plaintiffs' claims are dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
Basic Facts
A. On August 2009, Plaintiff B entered into an insurance contract called E with the Defendant, the insurer, as the insured, with the content that the insurance period from August 28, 2009 to August 28, 2021 (hereinafter “instant insurance contract”).
B. On his/her own book, the Deceased left a mersh with the purport that “B is blue now. The Plaintiffs are parents of the deceased.
Meanwhile, according to the terms and conditions of the insurance contract of this case, the defendant's damages are as follows.
Article 14 (Compensation for Loss) (1) If the insured has sustained an injury to his body due to a sudden and incidental accident during the period of insurance, the company shall compensate for the loss resulting from such injury in accordance with the terms and conditions of this Agreement.
Article 2 (Compensation for Non-Compensation) (1) The Company shall not pay compensation for any loss arising from the following causes:
1. The intention of the insured;
4. The self-harm, suicide, attempted suicide and criminal acts under the Criminal Act of the insured;
6. In the event of an accident of the insured or a mental illness of Article 16 (Death Insurance Money) (1) A company of the age of 15 or more suffers from an injury caused by an accident as provided for in Article 14 and dies as a result of its direct performance within two years from the date of the accident, it shall be entered in the insurance policy.
