Punishment of the crime

1. On July 17, 2014, Defendant A’s sole criminal conduct posted an advertisement stating that “I will sell camping goods,” using a computer on the Internet NVV website, and then deliver goods to the victim F who contacted by telephone, “I will first check the delivery of the price of goods, and deliver them to the customer F.”

However, the defendant did not have camping goods and did not have the intention or ability to sell the goods even if he receives the payment from the victim.

The Defendant, by deceiving the victim as above, received 450,000 won from the victim’s account of community credit cooperatives (Account Number: G) in the name of the Defendant around 15:09 on the same day.

In addition, the Defendant received a total of KRW 4,810,00 from around that time to July 31, 2014 by the same 24 times, as shown in the attached list of crimes (1).

2. On August 3, 2014, the Defendants conspired with the Defendant to publish an advertisement stating that “I will sell camping and fishing goods,” and then will deliver goods to the victim J who contacted with the Defendant by telephone after confirming the transfer of the price of goods at the first place.” The Defendants made a false statement to the effect that “I will deliver goods by door after confirming the transfer of the price of goods.”

However, the Defendants did not have camping goods and did not have the intent or ability to sell the goods even if they received the payment from the victim.

The Defendant, as above, by deceiving the victim as above, received 200,000 won from the account of community credit cooperatives (Account Number: K) in the name of Defendant B around 14:43 of the same day from the victim.

In addition, the Defendants’ list of crimes is attached between around that time and August 27, 2014.
