The plaintiff's claim against the defendants is dismissed in entirety.
Litigation costs shall be borne by the plaintiff.
Reasons
1. Basic facts
A. On August 2014, the Plaintiff filed a lawsuit against D with the Jeonju District Court No. 2019 Ghana12431 against D to claim for the lease deposit and was sentenced on May 29, 2019 to “D shall pay to the Plaintiff the amount of KRW 20 million per annum from August 1, 2014 to April 4, 2019, 5% per annum, and 15% per annum from the next day to the date of full payment.” The above judgment became final and conclusive.
B. On September 21, 2018, D entered into a sales contract with the Defendants on real estate listed in the separate sheet (hereinafter “the instant multi-family house”) with the Defendants in the purchase price of KRW 231 million, but the mortgage agreement on the instant multi-family house (the debt amount of KRW 55 million) and the lease agreement on the instant multi-family house (the total lease deposit amount of KRW 143 million for five households) with respect to the instant multi-family house (hereinafter “the instant sales contract”).
C. On October 8, 2018, the Defendants paid KRW 30,80,000 to D with sales remaining amount. The remaining amount is the amount calculated by adding the Defendants’ monthly rent of KRW 28,000,000,000,000,000,000,000 for the purchase price of KRW 231,000,000,000,000,000,000 for lease and KRW 143,000,000,000,000 for the multi-family house of this case, which is KRW 2.8,000,000,000,000,000,000 for KRW 40,000,00,000,000,000 for KRW 5,000,00 for the future E as a result of the conclusion of the instant sales contract.
The Defendants paid the remainder as above and completed the registration of ownership transfer in the name of the Defendants on September 21, 2018 with respect to each of the instant multi-family houses, each of the instant multi-family houses as of the same day, on the grounds of sale and purchase as of September 21, 2018, and thereafter, registered the debtor of the registration of ownership transfer in the instant multi-family houses as to the instant multi-family houses from D to Defendant
