A Imprisonment for one year, and each of the defendants B shall be punished by imprisonment for ten months.

However, this judgment is delivered against Defendant B.

Punishment of the crime

Defendant

B is the representative of D who supplies parts of the munitions, and the defendant A is the deputy head of the above D to take charge of the test results of the samples of the munitions.

When the Defendants supplied military units with munitions for the purpose of preventing the leakage of external fuel tanks to the F-5 mobile fuel tank, the Defendants requested the Korea Testing and Research Institute, etc. to issue a test report on the above parts, etc., but as the test result falls short of supply standards, the Defendants conspired to supply the relevant parts by altering the test report's numerical value.

1. Defendants’ joint criminal conduct

A. On April 201, the Defendants conspired with the Defendants to forge private documents and display the above investigation documents: (a) in the D office located in Chungcheongnam-si located in Chungcheongnam-si; (b) in order to enter the original copy of the test report issued under the name of the Administrator of the Small and Medium Business Administration in Daegu-si; and (c) to enter the number of other test results into the original test report; and (d) to attach the test results to the said original test report; (b) as a result of the test under the name of the President of the Korea Testing and Research Institute of Chemical Convergence (e.g., the number of private documents related to the certification of facts) for the purpose of exercising the test results in Chapter 1 of the test results of the Korea Testing and Research Institute of Chemical Convergence (e.g., for the prevention of leakage of external fuel tanks), “75” and “-50” as “72”; and (c) modified the above private documents with the rate of increase in seal strength “-46” as “6”; and (c) subsequently, submitted the modified private documents to the Minister of Defense.

B. On April 201, the Defendants conspired to alter the test report (type 1 for preventing the leakage of external fuel tanks) in the name of the president of the Korea Testing and Research Institute of Chemical Convergence (F-5) and submitted the altered private document to the Defense Technology and Quality Agency and received an inspection report from the Defense Technology and Quality Agency. On May 2, 2011, the Defendants supplied the Defense Acquisition Program Administration with one thousand five hundred (amount 104,569,500) as if they were to have received the normal test report using the said inspection report.
