A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

In around 2017, the Defendant found “C” in the first floor of the building B in Gwanak-gu in Seoul Special Metropolitan City as a customer, and became aware of the victim D (the age of 59) who operated the said singing room. After finding out the victim frequently in the said singing room, the Defendant unilaterally displayed the victim’s identification while indicating that the victim himself/herself is his/her husband and the child with his/her husband. However, the Defendant continued to display the victim’s identification, even though he/she refused to do so.

그러던 중 피고인은 2018. 8.경 위 C 노래방에서 피해자가 손님인 성명불상의 남성 3명에게 술을 따라주고 함께 노래를 부르는 모습을 보고 피해자에게 화를 내면서 피해자의 뺨을 수회 때리다가 위 남성들이 피고인을 제지하여 더 이상 때리지 못하였고, 그 무렵 서울 관악구 E에 있는 F역 인근의 ‘G’ 주점에서 술을 마시고 있던 피해자에게 전화를 걸어 욕을 하고 말다툼을 하다가 피해자가 위 주점 종업원인 남성(일명 ‘H’)을 바꿔주면서 ‘내 남자친구다.’라고 말을 하고 위 ‘H’가 피고인에게 욕설을 하자, 그 이후로 피해자에게 ‘너희 가게로 가서 그 새끼들 셋 다 죽일 거야. 그리고 너 있을 거니까 신고해라. 내가 배 쑤셨다고 미친년아.’, ‘너 어린애 시켜서 내게 욕하게 했지 그 핏덩어리 데리고 와라. 오늘 내가 아주 다 썰어줄 테니까.’라는 내용의 문자메시지를 보내는 등 피해자 및 위 남성들을 살해하려는 마음을 품게 되었다.

Since September 13, 2018, the Defendant: (a) sent the instant “G” sign while working in the vicinity of the F Station on September 13, 2018; (b) had the intent to kill the victim and the said “H” again; and (c) had the victim called the victim at the Defendant’s residence located in the Seoul Special Metropolitan City IHousing J on September 14, 2018; and (d) had the victim expressed his desire to do so before her “the victim called the victim.” (c) The Defendant knife knife with knife.
