Reasons
Punishment of the crime
1. The Defendant in violation of the Immigration Control Act is a person who operates “C” on the second floor of the building B in Gyeyang-gu, Busan Metropolitan City.
No person shall employ any foreigner having no status of sojourn eligible for employment activities.
Nevertheless, the Defendant employed D (E) (E) who is a Thailand with no status of stay from October 5, 2013 to November 5, 2013, and employed the F (GG students and women) who is the Thailand with no status of stay from October 5, 2013 to November 5, 2013, employed the status of stay from October 7, 2013 to November 5, 2013, employed H (I students and women) who is an Thailand with no status of stay from October 27, 2013 to employed it, and did not have status of stay from October 13, 2015 to October 5, 2013.
The Defendant employed 5 foreigners who did not have such status of stay as above.
2. No person who violates the Medical Service Act may establish a massage place unless he/she has been accredited by the competent Mayor/Do Governor;
Nevertheless, on July 2013, the Defendant did not obtain such recognition, and was equipped with approximately 132 square meters in the interior of approximately 132 square meters in the above “C”, as well as 4 and 8 marina rooms. As described in the preceding paragraph, the Defendant employed the female women of Thailand, thereby having an unspecified number of people, and received KRW 19,00 through KRW 46,00 per hour per customer.
From that time to November 5, 2013, the Defendant opened a massage place with an average of KRW 100,000 per day when he gets profits from many unspecified persons by the same way.
