A defendant shall be punished by imprisonment for not less than five months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

The Defendant is a person who operates a massage place in the trade name of “C” on the third floor of the building B in Busan Dong-gu, Busan.

No person, other than a massage club, shall establish a massage clinic.

Around 03:50 on February 19, 2019, the Defendant: (a) installed studio 8 at the instant establishment with a total size of 70 square meters; (b) installed 8 mebry for massage, smoking rooms, toilets, satisfaction rooms, and studs; (c) employed two women, who do not know their names, as employees; (d) received KRW 70,000, respectively, for massage expenses to D et al., a customer who found the said establishment; and (e) allowed women, the said her mother, who were not accredited as a massage, to take charge of the said customer D et al. and to take part in the bid and the blood transfusion from August 2018 to February 19, 2019 in such manner as above.

As a result, the Defendant established a massage place even though he is not a massage.

The Defendant is a person who operates a massage place in the trade name of “C” on the third floor of the building B in Busan Dong-gu, Busan.

No person shall employ any foreigner who has no status of sojourn eligible for employment activities.

Nevertheless, the Defendant employed women E, who were born from September 24, 2018 to October 12, 2018, as a marina branch, on the condition that they additionally pay 5,000 won per customer to 1.5 million won per customer, female F, who was born, from October 3, 2018 to October 12, 2018, and female G, who was born, as a mother branch, from October 5, 2018 to October 12, 2018 under the same condition.

As a result, the defendant employed three foreigners who do not have the status of sojourn eligible for job-seeking activities.
