Defendants shall be punished by imprisonment for eight months.

However, the execution of each of the above penalties for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On February 2014, Defendant A acquired one copy of his resident registration certificate that was lost by the victim D in the vicinity of the food boom in Pyeongtaek-si, Pyeongtaek-si.

The Defendant did not take necessary procedures, such as returning the acquired property to the victim, but did so.

Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.

2. Defendant B

A. On February 2014, the Defendant acquired one copy of the resident registration certificate of the victim E lost in the vicinity of the convenience store located in Pyeongtaek-si, Pyeongtaek-si.

The Defendant did not take necessary procedures, such as returning the acquired property to the victim, but did so.

(2) On February 2014, the Defendant acquired one driver’s license of a motor vehicle from which the victim H was lost at the G alcohol house located in Pyeongtaek-siF.

The Defendant did not take necessary procedures, such as returning the acquired property to the victim, but did so.

As a result, the defendant embezzled the assets that have been separated from the occupation of the victims.

B. On February 22, 2014, the Defendant on the unlawful uttering of official documents: (a) at the J agency located in Seo-gu, Seoan-gu, Seoan-gu, Seocheon-gu, Seocheon-si, the said agency’s employee, opened the above H’s cell phone under the said H’s name; and (b) received the said K’s demand for presentation of identification card.

The defendant presented as if he was the driver's license of H in the name of the Commissioner of Busan Local Police Agency, which is an official document in possession.

Accordingly, the defendant did not use official documents.

C. The Defendant attempted fraud

At the time and place stated in the paragraph, the victim K, who is an employee of the above agency, runs as if he was the above H, and changed the mobile phone to open and make a false statement.
