1. All of the plaintiff's claims are dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On March 31, 2008, the Plaintiff concluded each insurance contract on March 31, 2008 with Defendant A, the insured, and the beneficiaries other than death as Defendant B (hereinafter “instant insurance contract”). The instant insurance contract includes collateral for the payment of the daily amount of hospitalization when the insured is hospitalized due to illness or injury.
B. Defendant B received hospital treatment for 217 days from November 18, 2008 to June 22, 2009, as well as for 1,113 days on a total of 1,113 days, with bottled symptoms, such as mouth stroke, strokeum stroke, scokeum scoke, kne scoke, knene scoke, and urine, as shown in attached Table 2 from around that time to February 15, 2017.

The details of the instant insurance contract, which is similar to those of the instant insurance contract, among the insurance contracts for which the Defendants concluded as a policyholder with Defendant B as the insured, are as shown in attached Table 3.
It excluded cancer insurance contracts, savings mutual aid contracts, driver insurance contracts, etc. which are not similar to the content and nature of the instant insurance contract.
The amount paid by the Plaintiff to Defendant B as insurance money is KRW 53,409,922, and the amount confirmed as insurance amount paid by the insurance companies listed in the attached Table 3, including the Plaintiff, to Defendant B due to the instant insurance accident, etc. is KRW 59,358,422.
E. (1) The amount of income paid by Defendant A from 2007 to 2017 is as follows. From 2011 to 2016, the property tax was paid from D vehicles (tax base amount: 5,237,000 won) and E vehicles (tax base amount: 936,000 won).
