1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On January 29, 2008, the Plaintiff entered into an insurance contract with the Defendant, the insured, and the beneficiary other than death as the Defendant as the Defendant (hereinafter “instant insurance contract”). The instant insurance contract includes the security payment for the daily amount of hospitalization when the insured is hospitalized due to illness or injury.
B. The Defendant received hospitalized treatment for 16 days from May 1, 2008 to January 16, 2008, as shown in attached Table 2, from around that time to around January 23, 2017, for 32 times in total, as well as for 496 days from the time of being hospitalized.

Details of the guaranteed insurance contract of which coverage is similar to those of the insurance contract of this case among the insurance contracts in which the defendant is the insured are listed in attached Table 3.
The contract terminated before the conclusion of the instant insurance contract, and the fire insurance contract, etc., which cannot be seen as similar to the content and nature of the instant insurance contract, was excluded.
The amount paid by the Plaintiff to the Defendant is KRW 27,213,709, and the insurance company mentioned in attached Table 3 including the Plaintiff is KRW 136,832,962.

E. From 2009 to 2017, the Defendant paid the amount of income as listed below, and around February 2008, the Defendant acquired the ownership of 103 Dong 903 (tax base amount: 89,100,000) Seo-gu, Gwangju, Seo-gu, Gwangju, and paid property tax from around that time to 2012, and thus, paid property tax paid by the Defendant due to possession of real estate, etc. from 2007 to 2017 is a total of 18,457,050 won.
