A defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

[2017 Gohap 17] Special robbery Defendant 17 had no customer at the “D” convenience store in Jung-gu Incheon Metropolitan City during the normal wall time zone, and had used the convenience store to threaten employees to knife and take the cash at the convenience store and to force employees to take the convenience store.

On December 25, 2016, the Defendant parked the E rocketing car driven by the Defendant in the vicinity of the above convenience store (15cm in total and 8cm in length), and entered the above convenience store with the Defendant’s deadly weapon prepared in advance for the damages (15cm in length, 51cm in length), and took up the above excessive part of the part of the victim F (51 years in length) with the left hand, and led the victim less the part of the victim’s hand, as calculated, and took up three parts of the cash amounting to 150,000 won in total and the market value equivalent to 80,000 won in total, from the person suffering from the damage to drink, and 3 parts of the victim’s capital amounting to 150,000 won in total and market value.

In the end, the Defendant took a deadly weapon and took the victim's property forcibly.

[2017 Gohap 55] Larceny

1. On December 14, 2016, at the victim H’s house located in Jung-gu Incheon Metropolitan City building 204 around 00:20 on December 14, 2016, the Defendant, while living together with the victim, committed a theft with one gold half of the market price of the victim, which was on his/her book, and two hundred thousand won in cash, which was kept in the victim’s house located in the west-gu, Jung-gu, Incheon Metropolitan City building 204.

2. 피고인은 2016. 12. 14. 15:45 경 인천 중구 I에 있는 J 편의점에서 피해자 BGF 네트웍 스가 관리하는 현금 지급기에 위 제 1 항 기재 금반지 및 현금 20만 원과 함께 가지고 나온 H의 신용카드를 집어넣고, 미리 알고 있던 비밀번호를 입력하여 30만 원을 인출하여 절취하였다.
