A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
"2015 Highest 1591"
1. On March 2, 2015, the Defendant: (a) around Pyeongtaek-si 1, at the front of the new scenic apartment, parked the vehicle in front of the new scenic apartment; and (b) was frighting to the victim C (the age of 19) who was on the top of the next police station, with the attitude that it seems that the vehicle would be parked and then the increase would be made.
The Defendant received 850,000 won mobile phone 6 mobile phones in front of the E agency located in Pyeongtaek-si D on the same day from the victim of fright, and from August 11, 2015, from August 1, 2015, the Defendant 7 mobile phones in total amounting to 67,50,000 won from the victims of frighting, as shown in the attached crime list 1.
Accordingly, the defendant was given property by threatening the victim.
2. On April 1, 2015, at around 23:00, the Defendant made a false statement to the victim F (the 19-year-old) stating that “The Defendant would introduce a good job in which the Handphone is opened through one.”
However, even if the defendant is opened a mobile phone in the name of the victim, he did not have the intention or ability to introduce the job to the victim.
Nevertheless, on April 2, 2015, the Defendant received from the victim four mobile phones in total amounting to KRW 4,070,000,000 in four times, as shown in the attached Table 2 of the List of Crimes, from the H road located in Pyeongtaek-si G, a sum of which is equivalent to KRW 10,50,000, from the victim.
Accordingly, the defendant was given property by deceiving the victim.
Around April 29, 2015, the Defendant stated that “Around April 29, 2015, the Defendant would make a mobile phone opening of the 120-1.5 million won per week by using a cell phone opening to the victimJ.”
However, the defendant is against the victim.
