Defendant shall be punished by a fine of KRW 4,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

At around 13:00 on December 8, 2015, the Defendant inserted a letter that “Aphone 64 mobile phones will be sold in KRW 4.20,00,00,00” by accessing the Internet opening site using a computer at the off-site of Hongcheon-gun, Hongcheon-gun, Hongcheon-gun, Hongcheon-gun, Hongcheon-gun, and the Defendant made a false statement to sell the said mobile phone to the victim C who reported and contacted.

However, the defendant did not have the above mobile phone, and the above money was thought to be used for the purpose of debt repayment, etc., so even if he received the above money from the victim, he did not have the intention or ability to sell the opphone6 mobile phone.

At around 19:52 of the same day, the Defendant received 425,000 won from the victim to the Nong AC account under the name of the Defendant for sales price of the above mobile phone and for selective distribution expenses.

In addition, the Defendant received the total amount of KRW 9,424,00 from the victims in the same way 28 times through the same method as the attached crime list (1) between November 19, 2015 and December 17, 2015.

On February 17, 2016, the Defendant posted a letter stating that he/she sold a mobile phone (i.e., a mobile phone 6) at a place where he/she could not know on February 17, 2016, thereby allowing the victim E to believe that he/she owned and sold the said mobile phone.

However, the defendant did not have the above mobile phone so that he did not have the intention or ability to sell it to the victim.

The Defendant received 340,000 won as the price for the goods from the national bank account (F) in the name of the Defendant on the same day from the victim.

3. By no later than 22. As shown in the list of crimes (2) in the annexed sheet of crimes, 3,830,000 won was received through the same method not later than 11 times as the price for the goods.

Accordingly, the defendant was informed of the victims and received property.
