1. The Defendant is jointly and severally and severally with C to the Plaintiff KRW 32,00,000 and KRW 20,000 among them, from March 24, 2015 to December 12, 200.
Reasons
1. The facts following the facts of recognition do not conflict between the parties, or can be acknowledged in full view of Gap evidence Nos. 1-1-4 and Gap evidence No. 2 and the whole purport of the arguments.
The defendant is a dependent of C, and the plaintiff's denial of D.
B. The Plaintiff and the Defendant agreed to lend money to the Defendant and C as follows.
(1) Amount: The date of loan of KRW 20,000: The due date of repayment on February 24, 2015: 5% interest payment: The date of repayment on April 8, 2016: 24: The amount: 12,00,000 won: March 23, 2015; the due date of payment on April 8, 2016: 5% interest payment: (3) The date of loan of KRW 5,00,000 on March 27, 2015: The due date of payment on April 27, 2016: 5% interest payment: 3,000 per annum: 3,000,0000,0000 annually; and (5) the due date of payment on April 27, 2016: the due date of payment on April 27, 201: 3,000: the due date of repayment on April 28, 2015: The agreement on April 28, 2016.
C. On April 8, 2016, the Defendants repaid to the Plaintiff KRW 10,000,000,000, which was paid by the Defendants, and the Defendants paid to the Plaintiff KRW 3,4, and 5, the principal of the loans.
(The plaintiff filed the claim in this case on the premise that the above amount was satisfied as above, and the defendant does not dispute the above amount, and it is deemed that the plaintiff was satisfied as above).
2. According to the above facts finding as to the cause of the claim, the defendant is jointly and severally with C to pay 32,00,000,000 won in unpaid loans and 20,000,000 won in such loans (i) after the date of loan, as the plaintiff seeks after March 24, 2015 (which appears to be the date of initial payment of interest for the above loans), 12,00,000 won (ii) after the date of loan, as the plaintiff seeks, and the interest or delay damages calculated at the rate of 5% per annum, which is the rate of interest or delay damages from April 23, 2015 (which appears to be the date of initial payment of interest for the above loans) to the defendant from May 11, 2017 when each of the instant payment orders was delivered to the defendant.
