1. The Defendants jointly and severally with the Plaintiff KRW 130,000,000,
A. Of the above money, KRW 80,000,000 from November 11, 2016.
Reasons
1. Determination as to the cause of claim
A. The Plaintiff loaned KRW 80,00,000 on November 11, 2016 to Defendant B at the maturity of December 20, 2016, interest rate of KRW 12% per annum, and interest rate of KRW 24% per annum. The Plaintiff paid KRW 50,00,000 on December 27, 2016 after maturity of payment of KRW 12% per annum, interest rate of KRW 12% per annum, and interest rate of KRW 12% per annum, and interest rate of KRW 24% per annum. The Defendant C, D, E, and F guaranteed each of the above loans to the Plaintiff by Defendant B may be recognized by comprehensively taking into account the overall purport of the pleadings in each of the entries in the Evidence A (including the serial number).
B. According to the above facts, the Defendants jointly and severally pay to the Plaintiff the total amount of KRW 130,00,000 and KRW 80,000,000 out of the above money as agreed interest rate of KRW 12% per annum from November 11, 2016, the date of loan to December 20, 2016, the date of maturity, and KRW 24% per annum from the following day to May 18, 2017, the date of the final delivery of the original copy of the instant payment order sought by the Plaintiff, and KRW 15% per annum from the next day to the date of full payment. ② The Defendants are jointly and severally obligated to pay the Plaintiff the interest rate of KRW 50,000,000 from the following day to the date of loan to December 31, 2017, as agreed by the Plaintiff’s annual interest rate of KRW 15% per annum from the next day to the date of full payment.
C. Meanwhile, while the Plaintiff claimed the agreed interest and delay damages after the lease date as stated in Paragraph 2 of the claim, the Plaintiff sought a total of KRW 141,204,383 by adding each agreed interest and delay damages to the total amount of KRW 130,000,000 from the lease date to April 27, 2017 after the above lease date, and each agreement is agreed upon from the above lease date to April 27, 2017.
