A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

On September 2, 2011, the Defendant was sentenced to a suspended sentence of six months of imprisonment for fraud, etc. at the Changwon District Court on September 2, 201, and the said judgment became final and conclusive on September 30, 201.

1. On November 27, 2007, the Defendant: (a) was delegated by D to the sales contract for the third floor building located in C (hereinafter “instant building”); (b) around November 13, 2007, the Defendant entered into a real estate sales contract for the purchase price of KRW 460 million for E and the instant building under the name of the Defendant; and (c) thereafter, D completed the registration of ownership transfer of the instant building under its name on the ground of the said sales contract on February 27, 2008.

The Defendant believed that he was D, the owner of the building of this case, and had the mind to lease the building of this case.

On May 30, 2008, the Defendant: (a) around May 30, 2008, at the office of the new Si-Eup located in the Si-Eup-Gu, the Defendant: (b) stated “A”, “F”, “G” in the resident registration number column, “establishment of chonsegwon for the purpose of use” in the delegation column, “business relationship” in the delegation column, “a relationship” in the delegation column, and “D” in the delegating column; and (c) sealed D’s seal on the name adjacent to the name.

Accordingly, for the purpose of uttering, the Defendant forged a letter of delegation in the name of D, a private document on rights and obligations.

2. The Defendant exercised the above investigation document by submitting the forged power of representation to the public official in charge of issuing a certificate of seal impression who is aware of the forgery at the same time and place as described in paragraph (1) of the above Article.

3. The Defendant, who recorded the original of a notarial deed, was the owner of the building of this case at the I certified judicial scrivener office at H on May 8, 2008.
