Defendant shall be punished by a fine not exceeding five million won.

Where the defendant fails to pay the above fine, one hundred thousand won shall be paid.

Punishment of the crime

No one shall use any trademark identical or similar to another person's registered trademark on goods identical or similar to the designated goods, and shall cause confusion with another person's goods by using any trademark identical or similar to another person's name, trade name, trademark, container or package of goods, or any other mark widely known in the Republic of Korea as the goods of another person, or by selling, distributing, importing, or exporting goods using such trademark.

가. 상표법위반 피고인은 2015. 5. 28. 경 원주시 C 시장 1 층 105호 침대 등 판매점에서 고소인 주식회사 장수산업이 전기 돌침대 등을 지정상품으로 하여 특허청에 제 0750070호로 상표 등록한 ‘ 장수’, 제 0524178호로 상표 등록한 ‘ 장수 온돌’, 제 0543523호로 상표 등록한 ‘ 장수★★★★★’, 제 0990409호로 상표 등록한 ‘ 장수 돌침대’ 와 유사한 ‘㈜ 장수 돌침대/ 흙 침대’, ‘ 장수 구들 옥돌 침대’ 라는 내용의 간판과 현수막을 매장에 걸고 전기 돌침대에 ‘S .O .K. JIN SUNG 제조원. 판매원 ㈜ 장수 돌침대’ 라는 활 자가 표식 된 상표 라벨이 부착된 제품을 전시하고, 위 상표 등록한 ‘ 장수 돌침대’ 와 유사한 ‘ 거북이 표 장수 구들 옥돌 침대( 제조원 장수 구들)’,‘ 거북이 표 옥돌 침대/ 흙 침대 제조원 장수 구들’ 이라는 내용의 간판과 표시되어 있는 침대를 전시하는 등 그때부터 2018. 1. 31.까지 약 20개의 침대를 판매하여 고소인의 상표권을 침해하였다.

B.
