Defendants shall be punished by a fine of KRW 1,000,000.

The Defendants did not pay each of the above fines.

Punishment of the crime

No one shall use, manufacture, sell, or keep any trademark identical or similar to another person's registered trademark on goods identical or similar to the designated goods, and shall use the name, trade name, or emblem of another person widely known in the Republic of Korea or any other mark identical or similar to the name, trade name, or emblem indicating another person's business to cause confusion with another person's business facilities or activities.

1. Defendant A

가. 상표법위반 피고인은 2013. 5. 경부터 2014. 11. 경까지 전주시 덕진구 E 빌딩 1 층에 있는 침대 판매점에서, 피해자 주식회사 장수산업이 전기 돌침대 등을 지정상품으로 하여 특허청에 제 0524178호로 상표 등록한 ‘ 장수 온돌’, 제 0543523호로 상표 등록한 ‘ 장수★★★★★’, 제 0990409호로 상표 등록한 ‘ 장수 돌침대’ 와 유사한 ‘F’, ‘G’, ‘H’ 이라고 표시되어 있는 침대를 전시, 판매하여 상표권을 침해하였다.

B. The Defendant violated the Unfair Competition Prevention and Trade Secret Protection Act was confused with the victim’s business facilities or activities by using the signboard “I”, “J”, “K”, and “K” similar to the mark “the head of the victim (state) and fisheries widely known in Korea, in the outside and inside of the store.

2. Defendant B

가. 상표법위반 피고인은 2013. 12. 경부터 2014. 11. 경까지 전주시 덕진구 L에 있는 침대 판매점에서, 피해자 주식회사 장수산업이 전기 돌침대 등을 지정상품으로 하여 특허청에 제 0524178호로 상표 등록한 ‘ 장수 온돌’, 제 0543523호로 상표 등록한 ‘ 장수★★★★★’, 제 0990409호로 상표 등록한 ‘ 장수 돌침대’ 와 유사한 “M ”라고 표시되어 있는 침대를 전시, 판매하여 상표권을 침해하였다.

B. The Defendant violated the Unfair Competition Prevention and Trade Secret Protection Act is widely known to the date, place, and country under the preceding paragraph.
